This suit is brought to restrain the defendants from diverting surface waters onto the premises of the plaintiffs and to cause the removal of certain structures on a right of way to which the plaintiffs claim title by deed. The case was referred to a master who found that the plaintiffs suffered no damage on account of the diversion of surface water. He also made certain findings hereinafter referred to respecting the obstruction of the plaintiffs right of way. With the consent of all the parties an interlocutory decree was entered confirming the masters report.
